Welcome to Fun Slides Carpet Skatepark (“Fun Slides,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of our website, funslidespark.com (the “Site”), and your booking and use of our services and facilities. This document is a legally binding contract.

1. Agreement to Terms

By accessing our Site, purchasing tickets, booking a party, or using our facilities in any way, you, your minor children, and any guests you bring (“you” or “user”) agree to be fully and unconditionally bound by these Terms of Service.

These Terms explicitly incorporate by reference the full Fun Slides Assumption of Risk, Waiver of Liability, and Indemnification Agreement (the “Waiver”). Your agreement to these Terms constitutes your acknowledgement and acceptance of the detailed terms within the Waiver, including the assumption of risks, waiver of liability for ordinary negligence, and indemnification obligations. If you do not agree with any part of these Terms or the accompanying Waiver, you must not use our Site or services.

2. Booking, Payments, and Cancellations

a. Party Booking Process: To reserve a party, a non-refundable deposit is required at the time of booking. The remaining balance for your party is due and must be paid in full on or before the day of your scheduled event.

b. Pricing: All prices for admission, party packages, and other services are listed on our Site and at our facility. Prices are subject to change without prior notice. The price confirmed at the time of your booking will be honored.

c. Cancellation Policy:

Party Cancellations: All party deposits are non-refundable. If you need to cancel your party, you must provide us with at least fourteen (14) days’ notice. With proper notice, you may apply your deposit to a new, rescheduled date within six (6) months of the original party date. Cancellations made with less than fourteen (14) days’ notice will result in the forfeiture of your entire deposit.
No-Shows: If you fail to arrive for your scheduled party without any notification, your deposit will be forfeited, and you will not be eligible to reschedule.

d. Refund Policy:

Party Payments: All party payments, including deposits and final balances, are non-refundable.
General Admission Tickets: All sales for general admission tickets are final. There are no refunds for unused tickets or for guests who are removed from the facility for violating park rules.

3. Rules of Conduct, Assumption of Risk & Use of Facilities

Your safety and the safety of all our guests are our highest priority. Your access to and use of our facilities is strictly conditioned on your acceptance of the risks involved and your adherence to our rules.

a. Mandatory Liability Waiver: All participants, without exception, must have a valid and properly executed Assumption of Risk, Waiver of Liability, and Indemnification Agreement on file with us before entering the activity areas or participating in any activities. This must be signed by the adult participant or by the parent or legal guardian for any participating minor. This requirement is a non-negotiable precondition for entry and participation.

b. Assumption of Inherent Risks: The activities at Fun Slides—including but not limited to carpet skating, using ramps and obstacles, dodgeball, and bounce houses—are vigorous and carry inherent risks that are impossible to eliminate without destroying the unique nature of the activity. By participating or observing, you acknowledge and voluntarily assume all such risks, which include, but are not limited to:

Minor Injuries: Bruises, carpet burns, muscle strains, sprains, and lacerations.
Serious Injuries: Broken bones, joint injuries, and concussions.
Catastrophic Injuries: The rare possibility of paralysis, stroke, heart attack, or death.
Other Risks: Collisions with other participants or fixed objects, falls, loss of balance, equipment failure, and the negligent actions of other participants.

You acknowledge that you have read and understood the detailed description of risks in the Waiver and assert that your participation is voluntary.

c. Park Rules and Participant Conduct: You agree to abide by all posted safety rules and follow the instructions of Fun Slides staff at all times. By using our services, you specifically agree and assert that you (and any minor you are responsible for):

Will wear sneakers; no open-toed shoes, boots, or socks are permitted on the slides.
Acknowledge that helmets are highly encouraged for all participants and are required for children under 9 years of age.
Possess a sufficient level of health and fitness to safely participate.
Will report any injury, however minor, to staff before leaving the premises.
Authorize Fun Slides to secure emergency medical care at your own cost if deemed necessary.
Understand that failure to comply with any rules may result in immediate removal from the facility without a refund.

4. Intellectual Property & Photo Release

a. Intellectual Property Rights: All content included on our Site and within our facility, such as text, graphics, logos, and images, is the exclusive property of Fun Slides. This content is protected by U.S. and international intellectual property laws and cannot be used without our express written permission.

b. Photo & Video Release: As detailed in the Waiver, you authorize Fun Slides to photograph or video your participation and that of any minor with you. You agree that these images and recordings may be used in print, online, and video-based marketing materials without compensation or expectation of privacy. You release Fun Slides from any liability related to the reasonable use of such images for promotional purposes.

5. Disclaimers and Limitation of Liability

a. Disclaimer of Warranties: OUR SITE AND SERVICES ARE PROVIDED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS. FUN SLIDES MAKES NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SITE OR SERVICES, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

b. Limitation of Liability: TO THE FULLEST EXTENT PERMITTED BY PENNSYLVANIA LAW, IN NO EVENT SHALL FUN SLIDES CARPET SKATEPARK, ITS OWNERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, OUR SITE OR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF OUR SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO FUN SLIDES IN THE SIX (6) MONTHS PRIOR TO THE CLAIM ARISING.

6. Website Use

You agree to use the Site for lawful purposes only. You are prohibited from using the Site to post or transmit any unlawful, harmful, threatening, or fraudulent material. You may not attempt to gain unauthorized access to our systems, disrupt the service, or interfere with the proper working of the Site.

7. Governing Law

These Terms of Service, the incorporated Waiver, and any dispute arising out of or related to them shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania. You agree that the state and federal courts located in Allegheny County, Pennsylvania, have sole and exclusive jurisdiction over any legal action.

8. Changes to Terms

We reserve the right, in our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide notice by posting the updated terms on this Site. It is your responsibility to review these Terms periodically for changes. Your continued use of the Site or our services after the posting of any changes constitutes acceptance of those changes.
